1. ACCEPTANCE OF TERMS
By purchasing a Report, accessing the website, or using the services provided by AEOH.ai ("Service," "we," "us," or "our"), you ("Customer," "User," or "you") agree to be bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
If you do not agree to all the terms and conditions of this agreement, you may not use the Service.
2. ELIGIBILITY & AGE RESTRICTION
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
If you are accessing the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms. We do not knowingly provide services to minors. If we learn that a user is under 18, we reserve the right to terminate their access immediately.
3. DESCRIPTION OF SERVICE
AEOH.ai is an AI Engine Optimization (AEO) analytics platform that generates Reports showing how artificial intelligence systems (such as ChatGPT, Perplexity, and similar AI search tools) recommend businesses in specific industries and locations. The Service queries third-party AI models and aggregates their responses into structured Reports.
2.1. Report Contents
Each Report contains AI-generated recommendations, business rankings, citation sources, and search journey data for a specific industry and location combination at the time of generation.
3. AFFILIATION DISCLAIMER
AEOH.ai is an independent tool and is not affiliated with, endorsed by, or sponsored by OpenAI, Google, Microsoft, Perplexity AI, Anthropic, or any other AI provider. We are a third-party analytics service that queries publicly available AI interfaces to generate Reports. The AI providers mentioned have no control over, responsibility for, or association with our Service or Reports.
4. SNAPSHOT IN TIME DISCLAIMER
The Report represents a snapshot of AI search results at the specific moment of generation. We do not guarantee that these results will remain the same even 5 minutes later. AI models are non-deterministic by nature and are constantly updated by their providers. Rankings, recommendations, and citations may change at any time without notice.
You acknowledge that AI responses vary based on numerous factors including model updates, training data changes, query interpretation, and algorithmic modifications that are entirely outside our control.
5. NO GUARANTEE OF RESULTS
The Service is for analytical and informational purposes only. We do not guarantee that implementing suggestions from the Report will result in higher AI rankings, increased visibility, more traffic, or increased sales.
We have no control over OpenAI, Google, Perplexity, or any other AI provider's algorithms, ranking factors, or recommendation systems. The Report is a diagnostic tool showing current AI behavior—not a prescription for guaranteed improvement.
6. AI HALLUCINATIONS & INACCURACIES
The Service aggregates data generated by third-party Artificial Intelligence models. We are not responsible for inaccuracies, false information, or "hallucinations" produced by these models regarding your business, competitors, or any other entities.
AI models may generate factually incorrect information, attribute false statements, cite non-existent sources, or misrepresent business information. We report what the AI says—we do not verify, validate, or endorse the accuracy of AI-generated content.
8. SERVICE AVAILABILITY
We do not guarantee uninterrupted, continuous, or secure access to the Service. The Service may be suspended, restricted, or terminated at any time without notice for maintenance, updates, security concerns, or any other reason at our sole discretion.
You acknowledge that the Service depends on third-party infrastructure (hosting, AI providers, payment processors) which may experience outages, delays, or failures beyond our control. We shall not be liable for any loss, damage, or inconvenience caused by your inability to access or use the Service.
9. THIRD-PARTY SERVICE DEPENDENCIES
The Service relies on third-party AI providers (including but not limited to OpenAI, Google, Anthropic, and Perplexity) to generate content. These providers may change, discontinue, or modify their services, APIs, pricing, or terms at any time without notice to us.
We are not responsible for any changes, interruptions, or terminations of third-party services that affect our ability to deliver Reports. If a third-party provider becomes unavailable, we may modify, substitute, or discontinue affected features without liability to you.
10. NO REFUNDS POLICY (DIGITAL PRODUCT)
Due to the immediate digital nature of the Report, all sales are final. Once the Report is unlocked and accessible, no refunds will be issued.
By purchasing a Report, you acknowledge that you are purchasing access to digital content that is delivered immediately upon payment, and you waive any right to a refund under consumer protection laws that permit such waiver for digital goods.
8. PAYMENT TERMS
8.1. Pricing
Each Report is sold as a one-time purchase at the price displayed at checkout. Prices are in USD and may be subject to applicable taxes.
8.2. Payment Processing
Payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms of service.
8.3. Report Delivery
Upon successful payment, you will receive immediate access to the full Report. Report generation may take up to 5 minutes depending on AI response times.
9. AGGREGATED DATA USAGE
We may use anonymized, aggregated data from Reports to create market research, benchmarks, trend analyses, and to improve our services. This aggregated data will not identify you or any specific business.
Examples include: "Most searched industries in Warsaw," "Common citation sources for law firms," or "AI recommendation patterns by region."
10. INTELLECTUAL PROPERTY
10.1. Report Ownership
Upon purchase, you receive a license to use the Report for your internal business purposes. You may not resell, redistribute, or publicly share the full contents of a Report without our written permission.
10.2. Service Ownership
The AEOH.ai platform, website, branding, and proprietary methodology remain our exclusive property.
11. USER OBLIGATIONS
11.1. Accurate Information
You agree to provide accurate location and industry information when requesting a Report.
11.2. Lawful Use
You agree not to use the Service for any unlawful purpose, including but not limited to: defamation, harassment of competitors, or misleading advertising based on Report data.
11.3. No Automated Access
You may not use bots, scrapers, or automated tools to access the Service or generate Reports in bulk without our explicit permission.
12. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND REPORTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.
13. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AEOH.AI, ITS AFFILIATES, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON REPORT DATA.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM.
17. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AEOH.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:
- Your use of the Service or Reports;
- Your violation of these Terms;
- Your reliance on Report data for business decisions;
- Any claim that your use of Report data caused damage to a third party.
18. TERMINATION & SUSPENSION
We reserve the right to suspend, restrict, or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:
- Violation of these Terms;
- Fraudulent, abusive, or illegal activity;
- Non-payment or payment disputes;
- Actions that harm the Service, other users, or third parties;
- At our sole discretion for any business reason.
Upon termination, your right to use the Service ceases immediately. We are not liable for any damages resulting from termination of your access. Sections relating to disclaimers, limitations of liability, and indemnification survive termination.
19. NO PROFESSIONAL ADVICE
The Service does not constitute professional, legal, financial, marketing, or business advice. Reports are informational tools only and should not be relied upon as the sole basis for any business decision.
We are not consultants, lawyers, or marketing professionals. You should consult appropriate qualified professionals before making decisions based on Report data. We disclaim all liability for decisions made in reliance on our Reports.
20. FORCE MAJEURE
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party services (including AI providers, hosting services, and payment processors).
21. DISPUTE RESOLUTION
21.1. Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at hello@aeoh.ai and attempt to resolve the dispute informally for at least 30 days.
21.2. Jurisdiction
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Poznan, Poland.
21.3. Class Action Waiver
To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against AEOH.ai.
22. GENERAL PROVISIONS
22.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
22.2. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
22.3. Entire Agreement
These Terms constitute the entire agreement between you and AEOH.ai regarding the Service and supersede all prior agreements.
22.4. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.
