Terms of Service

By accessing or using the Service, requesting or purchasing an Audit, contacting us, or otherwise interacting with aeoh, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for a company, agency, or other organization, you represent and warrant that you are authorized to bind that entity to these Terms.

aeoh is a paid AI visibility product that generates Audits for a submitted business website and location. The current Service may include website capture, structured analysis, AI-generated findings, source references, payment flow, contact flow, export or sharing features, and related website content.

The Service is dynamic and may change at any time. We may add, remove, modify, suspend, limit, or discontinue any feature, workflow, model, integration, layout, metric, section, export, or output format at our sole discretion, with or without notice.

aeoh is independent and is not affiliated with, endorsed by, sponsored by, or officially connected to OpenAI, Google, Anthropic, Perplexity, Stripe, Vercel, Supabase, or any other third-party provider mentioned in the Service.

You are solely responsible for everything you submit to or request from the Service, including website URLs, locations, company references, contact messages, payment details provided to payment processors, and any instructions or data you ask us to process.

You represent and warrant that you have all rights, permissions, and legal bases necessary to submit the relevant website, business information, and any related data, and that our processing, crawling, storing, transmission to processors, and delivery of the resulting Audit will not violate any law, contract, confidentiality duty, privacy right, intellectual property right, or third-party right.

You remain solely responsible for verifying whether your use of the Service, any purchased Audit, and any subsequent publication, sale, transfer, or reliance on that Audit is lawful in your jurisdiction and appropriate for your business.

Every Audit is a time-specific, non-deterministic, informational output created through automated systems, website capture, third-party infrastructure, and third-party AI models. An Audit is not a promise, certification, benchmark of truth, or guaranteed representation of how any AI provider currently behaves or will behave in the future.

Rankings, citations, findings, summaries, recommendations, and all other outputs may differ over time, differ between runs, and change without notice due to model updates, routing changes, prompt interpretation, provider-side experimentation, upstream outages, data changes, or other factors beyond our control.

The Service depends on third-party providers and infrastructure, including hosting, payment, storage, rate-limiting, website-capture, analytics, and AI systems. Those providers may fail, delay, change, degrade, restrict, or terminate their services at any time.

AI systems may produce incorrect, incomplete, fabricated, misleading, stale, or inconsistent outputs, including hallucinations, false attributions, broken citations, missing sections, and faulty conclusions. We do not independently guarantee, audit, certify, or warrant the correctness of any AI-generated or AI-assisted output.

If an Audit fails to generate, generates partially, is delayed, or contains technical defects, our sole obligation and your sole remedy shall be, at our option and to the fullest extent permitted by law, regeneration of the Audit, service credit, or refund of the amount paid for that specific Audit. We have no other liability for generation failure, quality issues, or output defects.

Audit purchases are one-time digital-content purchases. Prices, currencies, taxes, features, and product descriptions may change at any time. Payment processing is handled by third-party processors such as Stripe. We do not store full payment card details.

Unless required by mandatory law, all purchases are final and non-refundable. We are not responsible for payment-processor failures, bank issues, card declines, chargeback decisions, exchange-rate differences, processor fees, tax treatment, or billing errors caused by third parties.

If you are a consumer in the EU or EEA and applicable law grants a right of withdrawal for digital content, you expressly request immediate performance once Audit delivery or generation begins and acknowledge that, where allowed by applicable law, you lose that withdrawal right after performance starts.

Subject to full payment, we grant the buyer broad, worldwide, perpetual, irrevocable, transferable, sublicensable, and non-exclusive rights in and to the exact purchased Audit only. For that exact purchased Audit, you may use, copy, edit, adapt, translate, publish, distribute, display, perform, transmit, transfer, assign, sublicense, sell, resell, and share the Audit for any lawful purpose.

These rights attach only to the specific purchased Audit. Buying one Audit does not give you rights to any other Audit, unpublished output, internal dataset, draft, tooling, feature, or future deliverable.

Your purchase does not transfer to you any ownership of or rights in the aeoh platform or the underlying systems used to create the Audit. Without limitation, you do not acquire any rights in:

• source code, software, scripts, internal tools, APIs, infrastructure, or databases;
• prompts, prompt templates, prompt strategy, model settings, or internal instructions;
• methodology, workflows, evaluation logic, heuristics, know-how, trade secrets, or internal research process;
• pre-output materials, intermediate materials, raw logs, hidden reasoning, or generation artifacts;
• our trademarks, brand assets, domain names, design, or website content; or
• any third-party provider systems, credentials, or service access.

All such rights remain exclusively with us or our licensors.

You may not, and may not permit others to:

• use the Service unlawfully, fraudulently, abusively, or for infringement, harassment, defamation, or deception;
• probe, scrape, spider, reverse engineer, decompile, benchmark, or extract the Service or its non-public elements;
• attempt to discover prompts, source code, internal models, security measures, or proprietary methodology;
• interfere with the Service, overload it, bypass rate limits, or circumvent access controls;
• use automated means to access or purchase the Service without our prior written approval;
• submit malicious, unlawful, infringing, or rights-violating content or targets; or
• misrepresent any Audit as our legal, financial, accounting, SEO, or professional advice.

The Service and every Audit are provided for informational purposes only and do not constitute legal, regulatory, financial, tax, accounting, investment, marketing, SEO, cybersecurity, or other professional advice. You are solely responsible for obtaining advice from qualified professionals before acting on any Audit content.

We may use de-identified, anonymized, and aggregated data derived from Service use, Audit requests, Audit outputs, and operational metrics to operate, secure, improve, benchmark, market, and commercialize the Service and related products, provided that such data does not identify you as a natural person.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, WEBSITE, AND EVERY AUDIT ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, QUALITY, OR RESULTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE FROM US CREATES ANY WARRANTY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER BLOCKFACTORY SP. Z O.O., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, EXPECTED SAVINGS, GOODWILL, DATA, BUSINESS OPPORTUNITY, REPUTATION, CLIENT VALUE, OR SUBSTITUTE COSTS, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY AUDIT.

THIS EXCLUSION APPLIES WITHOUT LIMITATION TO CLAIMS BASED ON FAILED GENERATION, DELAYED GENERATION, PARTIAL GENERATION, MISSING CONTENT, HALLUCINATIONS, INACCURACY, LOW QUALITY, FAILURE TO MEET EXPECTATIONS, FAILURE TO ACHIEVE BUSINESS RESULTS, THIRD-PARTY OUTAGES, PAYMENT ISSUES, SECURITY INCIDENTS, OR RELIANCE ON ANY AUDIT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR AN AUDIT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC AUDIT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under mandatory applicable law.

You will defend, indemnify, and hold harmless Blockfactory Sp. z o.o., its affiliates, and its and their personnel, contractors, and service providers from and against any claim, demand, investigation, action, loss, liability, damage, judgment, settlement, fine, penalty, cost, or expense (including reasonable legal fees) arising out of or related to:

• your use of the Service or any Audit;
• your breach of these Terms;
• your inputs, submitted targets, or requested processing;
• your sale, transfer, publication, distribution, or reliance on any Audit; or
• your violation of any law or third-party right.

We may suspend, restrict, or terminate your access or any order at any time, with or without notice, for any compliance, fraud, security, abuse, payment, legal, reputational, operational, or business reason. We are not liable for any resulting loss, interruption, or inability to access the Service.

These Terms are governed by the laws of the Republic of Poland, excluding conflict-of-law rules and excluding the CISG.

Before filing a formal claim, you agree to contact us at hello@aeoh.ai and attempt informal resolution for at least 60 days.

Unless mandatory law requires otherwise, the courts in Poznan, Poland shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service. If you are a consumer and mandatory law gives you additional non-waivable rights or forums, those rights remain unaffected.

To the maximum extent permitted by law, any claim must be brought on an individual basis and within one year after the claim arose.

We may modify these Terms at any time by posting an updated version on the website. Changes become effective upon posting unless we state otherwise. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms.
